Other events - Study presentation - Compatibility of national legislation with the EPPO Regulation - 23-01-2024 - Committee on Civil Liberties, Justice and Home Affairs

A presentation of the study launched by the Commission in April 2022 to assess the compatibility of national legislation with the EPPO Regulation will be held in LIBE on 23rd of January 2024.The study, published in December 2023, assesses whether national legislation complies with the main provisions of the EPPO Regulation. Despite the operational success of the EPPO, the first two years of its activities have also shown that there could be some difficulties for the effective functioning of the EPPO, stemming from the EPPO Regulation itself, irrespective of the Member States' implementation. Therefore, the study was later extended to include some of the most pressing issues concerning the efficiency and effectiveness of EPPO's activities arising from the text of the Regulation itself. The study identified a number of compliance problems. Despite the direct applicability of the Regulation, the successful functioning of the EPPO Regulation depends on the adaptation of the Member States. Moreover, the most worrying compliance issue identified relates to the independence of EPPO. Ms Gallego DG in DG JUST and Ms Kövesi will present their views on this crucial topic for LIBE.
