Shifting borders in EU Industrial Property Law

Fundamental Rights • Data and Trade Secrets • Competition • Cross Boarder Litigation

Objective

The webinar will offer a closer look at the increasing interaction between industrial property law and other legal regimes.

The relationship between IP law and fundamental rights has gained greater prominence in the case law of the CJEU. At the same time, digitalisation and evolving data access policies as well as the EU legal framework pose new challenges to the exercise of exclusive rights. Recent EU strategies aimed at promoting research and innovation also influence how the lawful use of exclusive rights is assessed in the context of competition law.

Together, these developments are reshaping the ways in which IP is valued, licensed, and litigated across Europe.

Key topics

  • Industrial property and fundamental rights in the light of recent rulings ( e.g: IKEA v.Vlamms)
  • Industrial property rights and trade secrets in the context of data access and data sharing
  • Evolving concept of IP innovation and its impact for exclusive rights
  • Standards on technologies and licensing issues
  • From legitimate IP protection strategies to competition law concerns
  • Recent issues on competent courts in cross boarder IP litigation (e.g: Dyson versus Dream and other cases)

Who should attend?

Lawyers in private practice, legal attorneys, in-house counsel, judges, other practitioners of law dealing with industrial property law and IP litigators handling issues at the crossroad between competition and IP law.
